01These terms
These terms govern the use of this website and the travel services arranged by Nostalgia Safaris ("we", "us", "our"). By requesting a quotation, paying a deposit or travelling with us, you ("you", "the traveller") accept them. If you book on behalf of other travellers, you confirm you are authorised to do so and that they accept these terms.
Your quotation, itinerary and any supplier conditions form part of our agreement with you. If these terms conflict with a written quotation we have issued, the quotation prevails for that booking.
02Quotations and pricing
- Prices are quoted per person sharing unless stated otherwise, in US dollars, and are indicative until a booking is confirmed in writing.
- Quotations reflect park fees, lodge rates, fuel and exchange rates at the time of issue. They are normally held for 14 days, and we will tell you when a quotation is shorter-lived — for example during peak season or when a supplier has limited availability.
- If park fees, government levies, taxes or supplier rates change before your final payment, we may adjust the price. We will always tell you the reason and the amount before charging you.
- International flights, visas, travel insurance, tips, drinks and items of a personal nature are not included unless your itinerary says so.
03Bookings and confirmation
A booking is confirmed when we have received your deposit and issued a written confirmation. Until then, camps, lodges and flights remain available to other guests, and we cannot guarantee availability.
A deposit of 30% of the trip cost is normally required to secure a booking, unless your quotation states a different amount. The balance is due 45 days before your arrival date, and earlier for peak season, special-event or charter bookings where suppliers require it. Where a booking is made inside 45 days of travel, the full amount is payable at the time of confirmation.
04Payments
- We accept bank transfer and, where available, card payments through our payment provider. Payment instructions are issued with your confirmation and never change without our written notice.
- Bank charges, card fees and currency conversion costs are the traveller's responsibility unless we agree otherwise.
- A booking is only treated as paid when cleared funds reach the account we have nominated.
05Cancellation and refunds
If you need to cancel, tell us in writing as soon as possible. Unless your quotation states otherwise, the following scale applies to the land arrangements we control:
- More than 60 days before arrival — deposit refunded, less any supplier cancellation charges and an administration fee.
- 30 to 59 days before arrival — 50% of the trip cost is retained.
- 15 to 29 days before arrival — 75% of the trip cost is retained.
- 14 days or fewer before arrival, or failure to arrive — 100% of the trip cost is retained.
06Supplier terms and refunds
Lodges, camps, airlines and charter operators set their own cancellation and non-refundable terms, which can be stricter than the scale above — particularly for peak-season, migration-season and fly-in bookings. Supplier charges are passed on to you and are not refundable by us.
Refunds are made to the original payer, less bank and card charges we have already incurred, normally within 30 days of the cancellation being agreed. Where a refund is impossible because a supplier will only offer a credit, we will pass the credit to you and tell you its validity and conditions.
07Events beyond our control
We are not responsible for failure or delay caused by events outside our reasonable control, including severe weather, floods, wildfire, road closures, park or border closures, airline schedule changes or strikes, civil unrest, epidemics, or government action. Where such an event affects your trip, we will work with our suppliers to rearrange, substitute or credit services, and we will pass on any refund we recover.
08Changes to your itinerary
Safari travel depends on nature and on local conditions. We may need to change the order of activities, the routing, the accommodation or the timing of a game drive for reasons of safety, weather, wildlife movement, road conditions, park regulations or supplier availability. Where we can, we substitute a property of the same or better standard and tell you before you travel.
If a change we make is significant and unavoidable, and you do not accept the alternative we offer, you may cancel that part of the trip and receive a refund for the services not delivered.
09Passports, visas and health
- You need a passport valid for at least six months beyond your return date, with blank pages for stamps, and any visa required for your nationality.
- You are responsible for meeting health and entry requirements, including yellow fever and other vaccinations, malaria prophylaxis and any testing or declaration in force at the time of travel.
- We are happy to point you to official sources, but entry decisions rest with the immigration authorities of each country you visit.
10Travel insurance
Comprehensive travel insurance is a condition of travelling with us. It must cover medical treatment, emergency evacuation and repatriation, trip cancellation and curtailment, baggage and personal liability, and any adventure activity on your itinerary. Please send us your policy number and emergency contact before departure.
11Liability
We act as the organiser of your journey and, for some services such as flights, as an agent for the supplier. We are responsible for arranging the services described in your itinerary with reasonable care and skill. We are not liable for the acts or omissions of independent suppliers, for loss or injury caused by circumstances beyond our reasonable control, or for loss of valuables left unattended in vehicles, camps or lodges.
You are responsible for your own belongings and for behaviour that respects wildlife, park rules, other guests and our guides' safety instructions. Guests who ignore safety instructions, endanger wildlife or other travellers, or break park regulations may be removed from an activity or the trip without a refund.
Nothing in these terms limits liability that cannot be limited by law.
12Photography
You are welcome to photograph your journey, subject to park rules and the wishes of local communities. We will only use photographs or video of you on our website and social channels if you give us permission.
13Complaints
If something is not right during your trip, please tell your guide or call our office straight away so we have the chance to fix it. If a problem is not resolved, write to us within 14 days of your return with the details, and we will investigate and respond in writing.
14Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute, without affecting any mandatory consumer protection rights you have in your country of residence.
